In this article I would like to clarify the difference between two very important Patent rules - First to Invent and First to Patent. Understanding these rules is extremely important and every novice inventor should know the difference between them.

First to Invent vs. First to Patent





Introduction:





In this article I would like to clarify the difference between two very important Patent rules - First to Invent and First to Patent. Understanding these rules is extremely important and every novice inventor should know the difference between them.





First to Invent Rule





First to Invent Rule states that the Unites States Patent Office (USPTO) will grant patent on an invention to an inventor who first invented the product. Please notice the word 'first' - and this is crucial because the original inventor might not be the first who submitted his invention to Patent Office! First To Invent Rule, which is obeyed in Canada and United States, helps in determining who is the rightful owner of an invention and rewards an inventor with proper patent.





First to Patent Rule





First to Patent Rule, on the other hand, grants patent to people who submitted Patent paperwork first! The rule is recognized by most European countries and is not very friendly to an inventor because the first person to publish an invention might not be an original inventor! First to Patent Rule encourages people to 'borrow' ideas from others and rewards them with new and shiny patents.





What can one submit as a proof that he is the original and rightful owner of the patent? Two excellent choices are Provisional Patent Application and Inventor Journal.





Provisional Patent Application





Provisional Patent Application may be the only source of proof that you are the original inventor and entitled to reaping the benefits of the patent. It is very possible that since the time you have submitted your Provisional Patent Application, someone else filled out paperwork for regular patent. The only thing that might substantiate your claim that you are the rightful owner of the invention is your Provisional Patent Application. One note of caution - Provisional Application is good for one year only and cannot be renewed. In fact, these applications were meant to be temporary solution until the inventor submits regular Patent Application Paperwork.





Inventor Journal





Inventor Notes or Journal is another popular method of keeping records regarding the time-line of your invention. In your journal you should write down every important date related to your invention with detailed explanation of your invention. Be as detailed as possible because the Journal might be the only proof that you are the original owner of an invention. It is a good idea to date every page and include diagrams and graphs that are pertinent to your invention. Ask your friends to read your Journal (your friends may not be as technical as you are, so be patient and explain your invention to them in plain language staying away from technical jargon). Ask your friends to date and sign your Notes - again, your friends are your witnesses and Patent Office will consider them.





Summary





As one can see, United States and Canada abides the First to Invent Rule and protects original owners of invention. Inventor Journal and USPTO Disclosure Documents are two excellent methods of documenting your invention and serve as a stepping stone towards filing Patent Application.

Because of this you want to do things that are in your own best interests.

The key thing to remember with fixed price contracts is that you are more likely to get stuck with the first bill with a new customer than anywhere else. Use fixed price contracts as way to entice new customers and to lower your risk of nonpayment. Your goal is to turn these fixed price contract customers into long term clients but first you need to know how willing and able they are to pay their bills.

Before you think about submitting your site to a search engine, you need to be prepared. Don’t think that because you have your domain name registered and a ‘under construction’ page up that you are ready.





Don’t even think about submitting your site to a single search engine until you are ready to receive guests or visitors. The worst thing in the world (I think so anyway) – is to follow a link to a website and only find a ‘under construction’ message or a front page with lots of links with ‘coming soon’ as a reward for my click.





Why did I come to your site? I want to either find out something interesting, look at something, download something or buy something – not to be told to come back later when you are ready – to tell the truth, I don’t think I would bother coming back. Even when you tell me to come back because I’ll remember and think “been there before, it was a waste of time, full of coming soon stuff”.





If you have a blog – don’t leave the messages saying ‘Just testing’ or ‘congratulations and welcome to your new blog’. Don’t even think about writing ‘Welcome to my blog, over the next coming few days I will be…’ Just remember, the internet has no concept of time, but humans do. If I come to your site and find a ‘Welcome to my blog…’ post with lots of promises, but you don’t deliver, why should I trust you with my time? My money? My business? The truth of the matter is, I won’t.





I’m not going to go through a whole list of things that tend to put visitors off staying on a site – but here are a few of them:





Broken links (always check your links before you upload to a site)



Awful color schemes (Yellow and Red? – Try pastel colors)



Tiny fonts – I like to be able to read without pushing my nose to the monitor.



Difficult navigation – I want consistency and clearly labelled links

In the excitement, you may forget their names. It is a good idea to jot down some relevant information on the back of the card to help you remember why or why not you like that particular contact.

One way to get to know those who come to the event is to volunteer to greet people as they come in. You are the first person they meet and then you can go up to them during the meeting with some ground under your feet and not feel so terrified.

Being a good listener is a key to being a good at networking. If you spend all your time talking about yourself, and how good you are and very little time, listening to them you will be wasting your time. Remember, people like to talk about themselves and if you let them, they will and they will leave the event thinking how much they enjoyed talking to you and will remember you. This is also an excellent way to glean information about them and the business they have to offer.

The other day I was struck by the “Hey! I invented that!” conniption fit. You know the one I’m talking about. It happens when you’re mindlessly watching TV and a commercial pops up marketing THE item you always told your friends, family, and anyone who would listen, was the next big idea and would make you tons of money. And there it is. On TV. Making someone else tons of money.

Or maybe you’re the type that gets spastic with the “ Psssh! I could make that!” twitch. Whether you have the “I thought of it first” knee-jerks or the “any five year old could do that” spasms, it all boils down to the same coulda-woulda-shoulda disease. The appalling disease of inaction and envy.

Tired of hearing stories of so-and-so selling such-and-such on eBay (“I could do that!”) or neighbor Joe making big bucks with his online business (“Didn’t I just tell you what a great moneymaking idea that is?”)… I took matters into my own hands and plunged into the world of web marketing and online business.

Now there were more than just a few “humps” or misconceptions that I had to climb over (alright, alright, I was dragged over kicking and screaming by the tow-truck of necessity). But here are two major ones:

1) Making a website is hard.

Well, I’m not going to lie to you and say it was peaches and cream, either. It turned out to be rather simple when I realized I didn’t need to learn any fancy new programs from the ground up. For real beginners, there are free html editors that you can download from the web; and if you’ve ever typed a document/essay/paper/letter in your life, you basically understand a textual layout and the things you can do to it. So fine. My first website was not very… attractive. In fact, it was rather boring. However, I had some fine power tools on my belt. I knew how to google.

The thing about the Internet is people like to talk, and they like to give out information for FREE. So I learned just enough html to understand the underlying structure, and I used that helpful little trick of “View>Source” (on simple pages, of course… simple but better looking than mine). I googled any html code abbreviations I didn’t understand. And voila – I had a website that looked… downright gaudy. Long story short, I learned the fine art of balancing a little too much with just enough. (Helpful hint: just because you now know how to highlight every other word, doesn’t mean you should.) And patting myself on the back over a job well done (at least until I can make enough money to hire pros to make my site uber-wonderful), I then ran into misconception number two.

2) If you build it, they will come.

It took me a while to realize that the only ones who knew of my existence were family, who I bragged to, and my hosting site, who I’m sure will remember me on "invoice day." You can see where I'm going with this next. Ok, I'm not going to re-hash everything you already know about bringing people to your site, nor am I going to preach to you about "conversion rates." Let's just say the bottom line for actually getting your website viewed, is to be creative. There have been hundreds (and will be probably millions) of e-books and the like which show you the sexiest ways to get traffic to your site, down to the simplest method like...hehe...writing an aticle. (dancing emoticon) A lot of good information out there is, again, free. Ultimately marketers want to sell you something, but you would be surprised at the amount of free information on the net that is actually worth something and is more than a baited hook. Poke around, do some research, check out a few forums, download a few e-books (free or paid), and above all get creative!

Getting in the Door: How I got my first Recruiting Job in Boston


The year 2005 must have been a slow one for recruiting agencies; at least it felt that way as I stumbled from interview to interview never quite landing the job. I don’t know why I suddenly decided to quit my sales job and become a recruiter, its just like a childhood dream that you never quite knew about that suddenly awakes and throws you into something interesting.

The year 2005 must have been a slow one for recruiting agencies; at least it felt that way as I stumbled from interview to interview never quite landing the job. I don’t know why I suddenly decided to quit my sales job and become a recruiter, its just like a childhood dream that you never quite knew about that suddenly awakes and throws you into something interesting.



My first encounter with a staffing agency had been in 2004, specifically with Creative Financial Staffing in Boston. A buddy of mine facilitated the hire that ended 3 week later with a pleasant “they will not be requiring your services” phone call from the recruiter. Apparently, I had dug up some really nasty collections issue that the supervisor did not want revealed (true story confirmed by insider).



So fast forward to 2005…



The summer was hot, maybe because I was running around in a nice suite from agency to agency trying to build a case why a young hard working graduate from Brandeis is a good bet. Yet I kept falling on my face. My Dad had bought me a really nice suit to help me out, but it just wasn’t doing it for me.



I interviewed with Robert Half, where the manager was the biggest ass you will ever meet, his name was Luke and he later became the division head of that great company. He told me I was a job hopper and that if I could hold on somewhere for more then a year to call him back. I actually did. This was just out of curiosity, by that time I had 35 people billing for me and had absolutely no desire to ever join Robert Half. But I digress…



I interviewed at Winter& Wyman in Waltham(later they tried to directly recruit me) then I went across the street to Sullivan & Cogliano. Undeterred, I interviewed at KNF&T in Boston, what amazed me about that company was the utter lack of men… anywhere. I managed to sneak into Sapphire for an unrelated job and tried to sell myself to the technical recruiter there by telling her that what I really wanted was “ to do what you do”. That must have freaked her out, recruiting being the competitive kill or be killed that it is J.



Then there was Maxim Staffing, they had a hole in the wall office, then to Apex Systems, better office still no offer. There was Ascent Consulting and lunch with my Dad who works in the same office park…. Then Resource Options in Needham, the way they described who they placed really turned me off.



I even interviewed at Time Warner for a collections job! Now I hate collections and anything to do with accounting and cubicle desk jobs, but hey, desperate times call for desperate measures! I went to SEDO.com, a reputable startup thinking they might take me for a sales guy, but alas, I didn’t come across as one.



And finally, when I despaired, and decided that maybe the world of recruiting had turned really was not for me, I interviewed at Total Technical Services in Waltham. You mean you’re trying to get people to sign up for the program with an initial investment of $11k to $14K in start up capital?” And then there is the ongoing monthly costs with the program which are significant.

There are four major components of workplace first-aid, namely; first-aider, first-aid, box, first-aid room, and first-aid equipment. When deciding on the number of first-aiders, first-aid box, first-aid room and first-aid equipment for the workplace, the following factors should be considered: type of industry, number of workers, number of work shifts, and location of workplace in relation to the nearest hospital or aid station.





If there is a shift work schedule, there should be a sufficient number of first-aiders for each shift based. In a work-site where employees of different employers, such as in construction, are working together.
